Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the websites, services, and communications of Adam C Fox Creative LLC ("ACFC LLC," "we," "us," or "our"), including FoxVoice, our business communications platform. By contacting us, requesting services, placing an order, or texting or calling our published number, you agree to these Terms. If you do not agree, please do not use our services.

ACFC LLC provides creative and technical services, including voiceover, audio and video production, web design and hosting, branding, and remote technical support, along with physical merchandise sold through our online store and fulfilled by Printful. We use FoxVoice to handle calls, voicemail, faxes, and text messages for our own business. Service availability, pricing, and descriptions may change without notice.

By placing an order you represent that you are authorized to use the payment method you provide. Payments are processed securely by Stripe. We may refuse or cancel an order for any reason, including suspected fraud, pricing errors, or availability. If we cancel your order, we will notify you and refund you in full.

Orders are fulfilled by Printful and typically ship within 2 to 7 business days after production. Shipping times vary by destination. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you upon delivery to the carrier.

Because our products are made to order, we accept returns or issue refunds for items that are defective, damaged, or incorrectly fulfilled. Contact us within 14 days of delivery with photos of the issue and we will make it right. We do not accept returns for buyer's remorse or sizing issues, so please review size charts before ordering.

Program name: the ACFC LLC text messaging program, operated under the name FoxVoice. Our program number is 541-304-3094.

Message types: customer care and service-related messages only, including replies to your questions, order and shipping updates, appointment confirmations, and follow-up about a project or service you have requested. We do not send marketing or promotional text messages under this program.

How you opt in. First, by texting us first. Our number is published on our website, our Google Business Profile, our printed materials, and our email signature; when you text 541-304-3094 you consent to our reply and to follow-up service messages about your project, order, or appointment. The disclosure published before you text is section 4 and section 5 of our Privacy Policy. Second, by phone or in-person intake. When you call us or meet with us and ask for text updates, we read you the following before collecting your number:

"Do you agree to receive customer care and service-related text messages from ACFC LLC at the number you provide? Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help at any time. Consent is not a condition of any purchase or service."

We record the number, the date, and your agreement in your contact record. No purchased, rented, or third-party lists are used to build our text messaging list.

Message frequency and cost: message frequency varies. Message and data rates may apply; your mobile carrier's standard rates apply to every message.

Opting out: reply STOP to any message at any time. You may also reply CANCEL, QUIT, OPTOUT, UNSUBSCRIBE, STOPALL, REVOKE, or END. We honor opt-out requests immediately and permanently for that number. You will receive one final message confirming that you have been unsubscribed, and no further messages unless you text START to resubscribe.

Consent is not a condition of purchase: agreeing to receive text messages is not a condition of any purchase or service. You may work with us without agreeing to receive text messages.

No sharing of opt-in data: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are never sold, rented, shared, or transferred to any third party or affiliate, for any purpose, including lead generation. Text messaging originator opt-in data and consent will not be shared with any third parties. See section 5 of our Privacy Policy.

Number eligibility and carriers: you must be the account holder, or have the account holder's permission, for the mobile number you provide. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your network operator and is not guaranteed.

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. You agree not to misuse our services, including by attempting to gain unauthorized access, interfering with their operation, or using them for unlawful purposes. We may suspend or terminate accounts that violate these Terms.

All content on our websites and in our services, including text, graphics, logos, images, audio, video, and software, is the property of Adam C Fox Creative LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

We rely on third-party providers to deliver parts of our services, including Printful for fulfillment, Stripe for payments, Resend for transactional email, and Twilio and Telnyx for calls, text messages, and faxes. Their services are governed by their own terms and policies.

Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Adam C Fox Creative LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services. Our total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim.

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions. Any dispute will be resolved in the state or federal courts located in Oregon.

We may update these Terms at any time. Changes take effect when posted on this page, and the date at the top of the page will change. Continued use of our services after a change means you accept the updated Terms.
